Schutzgegenstand bilden (noch) testierfähige Erblasser, welche aufgrund gesundheits- oder situationsbedingter Umstände an gewissen Widerstands- oder Rationalitätsdefiziten leiden und sich daher willensgeschwächt sowie verstärkt suggestibel gegenüber subtilem Beeinflussungsverhalten Dritter zeigen. Der Autor kommt zu dem Ergebnis, dass ein entsprechendes Schutzkonzept de lege lata durch eine richterliche Rechtsfortbildung anhand einer speziellen Abschlusskontrolle nach § 138 Abs. 1 BGB gewährleistet werden kann.
